2. Accounts & Eligibility
- You must be at least 18 years old to use the Services.
- If you register on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
- You are responsible for safeguarding account credentials and all activity occurring under your account.
3. Acceptable Use
You may use the Services to build, deploy, and operate document-processing workflows in accordance with documentation and these Terms. You may not:
- Violate any applicable law, including KVKK, GDPR, or Turkish regulations.
- Infringe or misappropriate intellectual property, privacy, or publicity rights.
- Attempt to access systems, data, or areas you are not authorized to use.
- Interfere with, disrupt, or degrade the Services or supporting infrastructure.
- Reverse-engineer, decompile, or attempt to derive source code or model weights.
- Circumvent usage limits, credits, throttling, or metering.
- Upload malicious code, unlawful content, or information you do not have the right to share.
4. Content & Intellectual Property
- Your inputs & outputs. You retain ownership over the inputs you provide and, to the extent allowed by law, outputs generated for you. Similar outputs may be produced for other customers.
- Documind IP. The Services, brand assets, documentation, and underlying technology are owned by Documind. No intellectual property rights are transferred to you except for the limited license necessary to use the Services.
5. Data Use, Security & Privacy
We process account, usage, and service data to deliver, secure, and improve the Services. Documind is undergoing SOC 2 certification and maintains industry-standard security practices, including encryption in transit and at rest, access controls, logging, and regular assessments.
- We respect and comply with KVKK and GDPR requirements, including data subject rights.
- Enterprise agreements may include stricter data residency, retention, or model-training controls.
- Refer to our Privacy Policy for full details on data collection, use, and retention.
6. Plans, Pricing & Credits
Documind may offer Free, Scale, and Custom/Enterprise plans. Pricing, credit allowances, and included features are listed on our website and may change over time with notice as described below.
- A “credit” measures usage (for example, document pages processed). Charges are based on credits consumed.
- You are responsible for taxes associated with your purchases. Documind may collect and remit taxes where required.
- We will provide at least 30 days’ notice before material price or rate increases for non-custom plans.
7. Billing, Refunds & Cancellation
- For paid plans, you authorize Documind or its payment processors to charge your payment method for applicable fees.
- You may cancel at any time via your account settings, which stops future recurring charges.
- Fees are non-refundable except when required by law or when Documind confirms a billing error.
- Free credits, if offered, are subject to the amounts, reset schedules, and eligibility criteria set out on our pricing page.
8. Enterprise Agreements
Custom or Enterprise plans follow a separate order form or master services agreement. If there is a conflict between that agreement and these Terms, the signed agreement controls. Enterprise contracts may include service-level commitments, data-handling restrictions, support SLAs, or tailored termination rights.
9. Third-Party Services
Some features rely on third-party providers (such as hosting, analytics, or AI model infrastructure). Those providers are responsible for their own terms and privacy practices. Documind is not liable for third-party services outside our control.
10. Service Changes & Discontinuation
We may improve, add, or remove features at any time. If we discontinue the Services entirely, we will provide reasonable advance notice and refund prepaid, unused fees where applicable.
11. Warranty Disclaimer
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCUMIND DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT OUTPUTS WILL BE ERROR-FREE OR FIT FOR YOUR USE CASE. You are responsible for validating outputs before relying on them in production.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED UNDER TURKISH LAW, DOCUMIND WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID DOCUMIND FOR THE SERVICES DURING THAT PERIOD OR (B) USD $100. Some jurisdictions do not allow certain limitations, in which case the limitations apply to the maximum extent allowed.
13. Indemnity
If you use the Services for business purposes, you agree to indemnify and hold Documind, its affiliates, and personnel harmless from third-party claims, damages, liabilities, costs, and expenses arising out of your use of the Services, your content, or your violation of these Terms.
14. Copyright & DMCA Notices
Report alleged infringement to legal@documind.cloud with:
- Identification of the copyrighted work
- Identification of the material claimed to be infringing and its location
- Your contact information
- A statement of good-faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act
15. Export Controls
You must comply with applicable export, re-export, and sanctions laws and may not use Documind in embargoed countries, by prohibited parties, or in violation of international trade restrictions.
16. Changes to These Terms
We may update these Terms periodically. If a change materially and adversely affects you, we will provide at least 30 days’ notice (via email or in-product notification). Other updates take effect when posted. Continued use of the Services after changes become effective constitutes acceptance.
17. Governing Law & Venue
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The competent courts of Istanbul, Türkiye have exclusive jurisdiction, and you consent to their venue. No mandatory arbitration applies unless expressly agreed in a separate written contract.
18. General
- You may not assign these Terms without Documind’s prior written consent; we may assign to an affiliate or in connection with a merger or sale.
- If any provision is unenforceable, the remaining provisions remain in effect.
- These Terms, along with any applicable order form, constitute the entire agreement for your use of the Services.
